New South Wales. Migration Updates

New South Wales has a very important role in the Australian migration program.

The state accumulates a lot of industries and businesses, and therefore it is popular among migrants.

This program year, the Department has allocated the maximum number of NSW nomination quotas among other states:

  • For visa SC 190 – 7,160 places
  • For visa SC 491 – 4,870 places

NSW has released a new skills occupation list, updated eligibility requirements, and pathways on how to apply for a state nomination in the current financial year 2022-2023.

This year, new rules were introduced for candidates:

To be eligible for NSW nomination you must meet BOTH the minimum point score AND minimum years of work experience in your occupation’s ANZSCO unit group.

Attention! There are specific points and work experiences for each occupation in the list.

Permanent visa SC 190

• The candidate selection for a state nomination is by direct selecting EOIs from the SkillSelect system.
• I recommend you make sure your EOI is up-to-date and that NSW is indicated as the primary state.
• State nomination and visa SC 190 may be applied by NSW residents or from overseas. Residency requirement: at least 6 months of residence in your location (in NSW or overseas).
• Not required to work for the nominated occupation. The location of the employer also does not matter.

Temporary visa SC 491

• The candidate selection for a state nomination is by direct selecting EOIs from the SkillSelect system within 2 pathways - through the RDA office or by the Investment NSW nomination.
• State Sponsorship and visas SC 491 may be applied by NSW residents or from overseas. Residency requirement: at least 3 months of residence in NSW or overseas.
• Not required to work for the nominated occupation. The location of the employer also does not matter.

Temporary visa SC 491 PATHWAY 1

• Available by application to the office of Regional designed Aria (RDA) where you would like to live for the next 3 years after your visa is granted.
• Applicants who have completed their NSW regional studies within the last 24 months are exempt from the minimum work experience requirement.
• Such candidates are eligible to claim points for Study in regional Australia as well.
• The rule of minimum score requirement for the ANZSCO unit group is applied.
• Each RDA office sets its application fees.

Temporary visa SC 491 PATHWAY 2

• Implemented by invitation from the state issued during the invitation round.
• Applicant must apply to Investment NSW within 14 days of being invited.
• A non-refundable application fee of A$330 (including GST) if applying from within Australia, or A$300 if applying from outside Australia.

• Implemented by invitation from the state issued during the invitation round.
• Applicant must apply to Investment NSW within 14 days of being invited.
• A non-refundable application fee of A$330 (including GST) if applying from within Australia, or A$300 if applying from outside Australia.

In the meantime, some facts for NSW sponsorship candidates:

  • All requirements could change without notice, the state reserves this right to effectively manage the migration program.
  • Occupation lists are only reviewed once a year, which means the NSW SOL will not change until next year.
  • NSW SOL is specified by the ANZSCO unit groups. To be considered for NSW nomination, you must hold a valid skills assessment for an occupation that is BOTH eligible for the specific visa AND falls within an ANZSCO unit group shown on that visa’s skills list. 
  • Invitation rounds occur ongoing throughout the financial year. The state cannot advise the date of upcoming invitation rounds.
  • Invitation links are only valid for 14 days – candidates must apply within that time. The state will not reissue your invitation if the link expires. 
  • You can only be nominated by NSW only once. If you do not apply for a visa, you will forever lose your chance to be nominated by this state.
