Changes in GTE assessment for visa 482

Starting from August 2, 2024, the updated criteria for assessing Genuine Temporary Entrant (GTE) requirements for 482 visa applicants became effective. It means that the default position now is that GTE is met unless specific concerns exist. Additionally, the factors that may give weight to GTE not being met have been reduced significantly.

Having multiple temporary visas (including other short-term 482 visas) and not having left Australia for prolonged periods is NOT listed as a factor against GTE within the current policy.

Here are the remaining factors that could suggest non-compliance with GTE requirements: 

  • The applicant has not met the conditions of previous visa(s), had their visa canceled, or is facing cancellation (excepting 457 or TSS visas after employment has ceased, and the applicant was offshore).
  • There are substantive inconsistencies in the information provided by the applicant in their TSS visa application that cannot be reconciled.
  • The applicant has made two or more unsuccessful TSS applications (either refused or withdrawn), particularly if there’s a mismatch in the nominated occupation.
  • The applicant is on a blacklist for fraud.
  • The applicant or their family has a troubled visa history in Australia or other countries.
